Rukiga’s Muhanga Town clerk, mayor on spot over land grabbing

NEWS- The Town clerk Muhaga town council Eudia Mutabazi together with the Mayor Twijukye James are riding on a hot streak for allegedly using their positions to steal peoples’ land and destroying properties.

This follows the recent judgment issued by the chief magistrate’s court of Kabale between James Mansa (the Plaintiff) Vs Muhanga Town council (The Town council) over the suit land located in Muhanga Cell, Muhanga ward, Muhanga Town council in Rukiga district.

In the land dispute which was taken to Court in 2019, James Mansa was accusing the town council for illegally heaping soil on his land damaging his two fish ponds with fish therein worth millions of money as well as his fence in a way of forcing the Road to pass.

In the judgment issued on 22nd August 2023 by the His Worship Olupot Pascal, Mansa James (the Plaintiff) had 2 fish ponds on the contested land and a fence which were destroyed by the action of the defendants (The Town council) by spreading the soil thereon.

James Mansa, the Plaintiff told this reporter that the case was dismissed with costs in his favor waiting for the proper damage assessment to determine the costs involved to be paid by the Town council “the defendants”.

On the other hand, Muhanga town council was denied to access a piece of land about 115 by 100Ft located in Muhanga Cell, Muhanga ward, Muhanga Town council, where the Town council and the Town Clerk have been claiming that it’s for the government whereas the community says that it’s for the late Yosia Kikona.

Fencing off the land where the town council was using as a garbage collection center, the only surviving son to the late Yosia Kikona, Mbabazi Benard (Kabana) a businessman from Kampala and a resident of the same area said that they wrote several letters to the Town council top leaders (Town clerk and Mayor) to stop using their land but al was in vain.

When asked as to why they decided to put the fence on the said land, Benard said that it was intended to show that they are ready to use the land urging the town Clerk or the mayor to run to court if they have any proof that this land isn’t theirs.

Kabana said that they had earlier taken the town council to Police with the Town clerk and the Mayor claiming that the land belongs to the government from which they failed to present the evidence that they own the land.

When asked of how the town council got access to the land, Mbabazi said that his late brother who was the area LC I Chairperson Tibarirana Justus helped the town council to use the said land for a short time but after learning that he had died, the town council officials continued using it and claiming that it is for the government.

When contacted by this reporter to have an insight on the judgment and the claimed land, the Mayor Muhanga Town council James Twijukye, said that he has not seen the Judgment of the contested land.

Twijukye confided to the press that he was aware of the activities that were going on (fencing off the land) committing to regain the land saying that it’s for the government.
